April 26, 2010

The meeting was opened at 7:00 p.m. by Chairman Ronald Broman.  Also present were members Edward Sheehan, Mary Ann Gray, Allen Ward, and Health Agent Judith Giorgio.  Member Ted Whittaker was absent.  The minutes of April 12, 2010 were approved.  The correspondence was reviewed.

Cont. variance hearing and approval of I/A Technology for:  Est. of Francesca Stone, 28 Nob Hill Road, Clark Engineering;   

Continued hearing from April 12, 2010 meeting.

Ryder & Wilcox, Inc. has conducted their surveying for the abutters (Doyle) property and found no variations from the survey presented by David Clark.
The Doyle’s were in attendance and they were satisfied with the plan as proposed at this time. Attorney Bill Riley was in attendance for the Estate of Francesca Stone, owners of the property.

The BOH is in receipt of revised floor plans indicating three (3) bedrooms.

The applicant is requesting the Board approve the use of Innovative/Alternative Technologies for remedial use.  They are proposing to use a Singulair system with a Perc Rite drip disposal system.  In order to upgrade the system they are requesting the following variances to Title 5 and Chatham Board of Health Minimum Standards for the Disposal of Sanitary Sewage:

1.  310 CMR 15.212; Vertical separation distance fo the bottom of the SAS above the high ground water elevation, 5 ft. required, 4 ft. provided.  A variance of 1 ft. is required.
2.   310 CMR 15.2.11; Distance of SAS to wetland, 50 ft. required, 47 ft. provided.  A variance of 3 ft. is required.
3.  Town of Chatham Subsurface Sewage Disposal of Sanitary Sewage Sec. 4.2; Distance from SAS to wetland resource area, 100 ft. required, 47 ft. provided.  A variance of 53 ft. is required.
4.  310 CMR 15.2.11; Setback from SAS to property line, 10 ft. required, 4 ft. provided.  A variance of 6 ft. is required.

The BOH is in receipt of a memo from Judith Giorgio recommending approval of this variance request with conditions.  

Ed Sheehan made the motion to approve the variance request and use of I/A Technology with the following conditions:

  • The applicants shall restrict this property to a maximum of three (3) bedrooms and record this restriction at the Barnstable County Registry of Deeds.  The applicants shall submit a copy of the executed deed restriction to the Health Department.
  • Throughout its life, the system shall be under an operation and maintenance (O&M) agreement.  O&M agreements shall be for at least one year and may be with any Massachusetts certified operator of the appropriate grade that has received training by the Company on the operation of the system.
  • Effluent from the system shall be monitored at least once per calendar quarter.  The effluent shall be monitored for TN and Ammonia, for a minimum of two years.  A performance standard of 19 mg/l is required to be met for Total Nitrogen.  After the required two years an application can be made to the Board for review and possible modification of the monitoring requirements.  Water meter readings are to be provided with the quarterly reports.  
  • The applicant shall sign a covenant with the Board of Health agreeing to comply at such time as the Town of Chatham, through its Board of Health or Board of Water & Sewer Commissioners, directs the connection of this property with whatever wastewater management option specified for this watershed in the adopted Comprehensive Wastewater Management Plan.  This covenant shall be recorded at the Barnstable County Registry of Deeds and a copy of the executed covenant shall be submitted to the Board of Health.
  • The applicant agrees to apply a minimum of six (6) inches of compacted topsoil to all landscaped areas of the property.
  • A certified as-built plan with as built elevations (stamped and dated by the design engineer) of the septic system shall be submitted to the Health Department for review, prior to the issuance of a Certificate of Compliance.    
  • No alteration to the floor plan of the property shall be allowed without further review by the Board of Health.
  • This approval is based upon the site plan dated March 15, 2010, prepared by Clark Engineering and received by the Health Department on March 29, 2010.
  • This variance is granted pursuant to the State Environmental Code, Title 5, and the Town of Chatham Nitrogen Loading Regulations is valid for one year from the date of the Board of Health approval.  A permit must be issued, and work commenced during that one year period or the variance shall expire.
Motion seconded.  Unanimous.
The Health Agent is to write a letter to the owner and engineer to this effect.

Update on State Beach Regulation and permitting;
Bob Duncanson is taking the lead with the beach permitting, since he does the testing of the bating beach waters in Chatham. He will be sending out letters to the beaches he currently test, and will work with Judith to determine if there are any others. Ed asked whether community associations are included in this. Judith stated that they would be if they have swimming areas for the neighborhood, even though they are considered private beaches. Barnstable County Health has developed signs for the Towns to purchase at a bulk rate, 10.00 per sign, and we will make them available to the semiprivate beaches as well. No other news from park and recreation regarding the status of Light House Beach or North Beach.
Ed Sheehan noted that he feels that communication is essential between the Boards on this issue.

Upcoming communication drill for EDS plan;
Judith updated the Board on plans to conduct a communication drill for the activation of an EDS site. She met with the town’s emergency management assistants, Dick Hunter and John Cauble and updated contact information for this drill, as well as for an overall communication drill in case of a public health emergency.
Ron Broman asked about who would be in charge in such and emergency, and what is the BOH’s role in the Towns Comprehensive Emergency Management Plan? Judith explained that we are the lead agency in a public health emergency, with police and fire handling security and safety issues.  During an all hazard emergency such as a hurricane or blizzard our role is during the clean up phase for food and water protection issues.  Ron expressed concern that Judith and Bob would not be available during an emergency and a back up should be identified. Judith stated that it would be unlikely that they both would be unavailable, but that the Board of Health should familiarize themselves with the PH emergency plans.  In addition she continues to work with the MRC and the County Health Department and Health Agents Coalition to plan for emergencies.
Judith will as John Cauble to come to a future staff meeting to discuss the towns Comprehensive Emergency Plan, which is currently being updated.

Upcoming MRC meeting on June 21, 2010;

Jean Roma will be attending the June 21 meeting and our volunteers will be invited as well. Judith stated that she continues to try and identify team leaders in each town covered by the MRC. The appreciation luncheon is May 19th at the Cape Codder in Hyannis.
